Hello everyone,
due to the expected rising energy prices, we decided on a KfW70 house.
A local developer advertised a construction project for the erection of KfW70 townhouses, and my wife and I took the opportunity.
To ensure nothing goes wrong, we had it guaranteed in the notarized purchase contract that the townhouse would be built as a KfW70 house.
After much trouble on the construction site (delays, poor workmanship... the usual), the KfW70 calculation was commissioned again (second expert office).
And what was the result? KfW94
The original calculation by the expert office was faulty due to incorrect data transmission from the architect.
The developer does not want to take responsibility because the (old) expert office issued the KfW70 confirmation. The (old) expert office does not want to be responsible because the architect provided the wrong numbers, and the architect has meanwhile filed for bankruptcy.
The construction project was not built with renewable energy sources, which seems to be the decisive criterion for the non-fulfillment.
How do you assess the situation?
Since we have already moved in and everything is finished, retrofitting will be difficult, right?
It probably only leaves the option of financial compensation.
But what amount / calculation basis would be appropriate?
