Is it possible to reroute the neighbor's sewage pipe?

Hello,

I have a somewhat "tricky" problem or question regarding wastewater.

Two unregistered and nowhere documented wastewater pipes for rainwater (Pipe 1) and wastewater from a washbasin + bathtub (Pipe 2) run across our undeveloped building plot. Both pipes belong to the neighbor and have been crossing our property towards the street for over 50 years. There they flow into the public wastewater distributor. The neighbor does not pay any wastewater fees for both pipes because the pipes officially do not exist...

Since these pipes are now quite obstructive when a house is to be built, we are considering how to relocate them as cost-effectively and with the best solution for all parties involved.

Here is the current actual situation:


Our plot is the orange-colored parcel. The brown arrow shows the existing slope. The green square is to be the future house.
You can see the two unregistered blue wastewater pipes and also 2 small roof gutters of a building that flow onto our property.
So far, all this was unproblematic.

Now we have been thinking since we need a wastewater connection anyway. We came up with the following idea (marked in red). Our wastewater connection has to be laid anyway, plus a pipe from our house to the distributor (that would be our costs).
The neighbor could lay his roof gutters and the other two old pipes in a new pipe on his property, then lay it under his path towards the street and at the end of the path again onto our property and into our connection. This way he could simply hook up his pipe. He would pay the costs for laying it on his property. He would not need his own connection because he can use ours. His path, under which the pipe is laid, will be completely renewed in a few weeks/months anyway.



Now I would be interested in your opinion, what do you think, is this possible this way, is it fair for both sides and would it be legally possible without any problems?

Hi,

there is actually nothing in the [Baulastenverzeichnis]? And why is the neighbor supposed to be connected to your sewage shaft? That would mean that the neighboring property is not developed.

Every property must be developed. There are easements and obligations, but each property must have its own connection....

Hello,

the neighboring property is very large and has several buildings, and there is also a sewage connection there. However, the two sewage pipes that run over our property are from an old barn building, but quite a bit of water already flows through them. Rainwater from the yard area and the field also flows through there.

If the neighbor now wants to integrate these pipes into his existing system, he would have to completely tear up his entire property - everything there is already properly done and paved...

Now the question is what to do...

Definitely do not have it connected to your RW shaft. Either the lines stay where they are and you have to register a building encumbrance on the property at your expense, or the lines have to be completely routed around your property. I do not see any other option.

Hello,

well, we need the new connection anyway. We actually get along well with the neighbor. Now the question is why can't he just have his cables privately rerouted and connect to our connection? That would help him (no extra connection), help us (2 cables disappear), and the costs would be manageable for both sides...

Why can't he connect through us? If we register the easement, we always have problems if something ever happens with the cables... and later on you would be quite restricted when it comes to digging in those areas...
