Is green space convertible to building land?

Hello everyone,

in the picture you can see a very old development area in a town, to the west of which a "field" adjoins (circled in red), which is not designated as building land.

Assuming the farmer wanted to sell me this piece of land - would it then be possible to develop the property at my own expense and build a house there?

I don't think so, as far as I know, the district administrator or someone like that has to first designate the purchased land as building land. That increases the value of the property.

Arable land is arable land. Before it becomes building land, it first becomes land with development potential. However, a regional development plan (demand-based) gives a land use plan a push to designate such areas. On that basis, a development plan is then created. So, the Prussians don’t shoot that fast – not even at rooks.

If you are considering a career change, you could switch to farming and, taking into account the requirements mentioned in §35 Baugesetzbuch, also build in the external area.

Talk to the municipality. It is not impossible. But clarify that. Ultimately, a change to the development plan is needed. Not easy, because in our densely populated country, a municipality must have good reasons to convert farmland necessary for food production into building land. Changes to the development plan do not happen quickly. In addition to resolutions, there are also periods for public inspection to observe. If necessary, a local development plan must also be submitted. All this will probably also overwhelm you financially. The only remaining way, which is at least not impossible in SH, is to get a development in the outer area approved with the support of the municipality. Note, a single development. Like one house on the entire field. It would be helpful if you have something to do with agriculture, so to speak building a retirement part. As said. Talk to the municipality.

The prospect of success only exists if all the conditions of an agricultural land are right, including the farmer himself. But even then, he will surely have to wait years. Buying first to then speculate on building land has almost no chance, unless there is a shortage of building land in the district. Such matters are also weighed alongside the social component ([Farmer Family Own Land]). Bargain hunters, on the other hand, are not supported. That's just how it is.
