Is exclusion of warranty possible in the offer for time and material work?

Hello everyone,

I have ordered our rain shower in an online shop, and the sanitary company from our builder is kindly installing this rain shower on an hourly basis (63€/h net).

Can the sanitary company actually exclude warranty and guarantee on their work in their offer? I understand that the company cannot give any warranty or guarantee on the material, but doesn’t the sanitary company have to provide a warranty on the sanitary installation? After all, the hot water pipes for the rain shower come from the company. The installation has already been carried out.

The offer included the following passage:

"Regiearbeit
Montage - nur UP-Körper - der bauseits gelieferten Regendusche und 2x Duschsystem
werden auf Nachweis direkt mit dem Bauherren abgerechnet!
Für diese Arbeit übernimmt die Firma Hozlinger keine Garantie und Gewährleistung!"

I guess it depends on where the water damage occurred.

Does it read as if you have a contract with the BU and have agreed on hourly-based installation with a subcontractor of the BU (?)

The plumbing company also does the remaining installation work in my house. I also obtained the other plumbing fixtures through this company or [BU].

My only concern is whether the company is still liable if the product was connected incorrectly?
