Is an assignment clause mandatory?

I know plenty of those too, but whatever.

You have no idea about credit risks at the overall bank level. It’s not about collateral (which of course naturally reduces risk) but about the remaining risk amount that is eliminated.

And it’s certainly not about annoying an individual borrower.

What costs does such a borrower incur because of this?

Can you please name a few banks that operate without this assignment clause. Because for me it is currently.

For example, my employer. And many other savings banks. The clause is indeed present in the [AGBs], but will gladly supplement the credit agreement at the customer's request with a clause that excludes the sale of the loan and the application of this point.

The assignment clause can be removed or modified in such a way at almost all Volks- und Raiffeisenbanken that a claim sale is only possible within the cooperative group.

Personally, I don’t care. Only the debtors who cannot service their financing have a problem. Who the creditor is then is secondary (even though it’s always the “evil banks” that push the debtors into ruin, divorce, suicide, etc....).

Claims are also sold where the debtor has never been in default. That is the problem.

Hello sisqonrw,

although I left the first link as it can still be considered reputable, I have deleted your link from this post; the source is in my opinion only for presentation purposes (is that also said for internet appearances?). Please observe the forum rules according to which posting links is not allowed.

Thank you very much!

Of course, only non-performing loans are sold. That is the point of the matter. In such sales, usually no non-performing loan may be sold along with them.

Non-performing loans cannot be sold at all, except to a collection agency or the like.

Again, the question: What disadvantage (what costs) does the borrower have in the case of a debt sale?
