I do not understand your statement here in context. What I meant was the following: The hedge growth with the tall thujas is on the north boundary of the affected neighbor, so he can possibly accept it without much impairment. After all, not much light comes from the north in our latitudes. For the OP, the cypress hedge would be on the south of his property, therefore my note to possibly keep an eye on the shadow casting here before too much impairment occurs. The planned house will probably not be affected at all because it will presumably be far enough away from the boundary, only the garden.

I have indeed understood the text, but I am not a lawyer, just a layperson.
My understanding results in the following legal situation:
In the South, according to §27, the original owner is actually obliged to enclose the property, so no communal enclosure applies. Therefore, according to §50, the distance regulation also applies, as it explicitly applies to hedges as well.
However, the neighbor has preceded the original owner’s enclosure obligation.
I do not think I have misunderstood this. Otherwise, I ask for clarification.
