Hello, we are buying an apartment from SÜBA Karlsruhe in 2 weeks. How can we protect ourselves against a bankruptcy? Is it rude of the marketer to demand a credit report? Additionally, the contract provides for a payment according to the broker and developer ordinance and the shell construction + roof + windows are already in place. The payment goes directly to the bank which has registered a land charge.

You can do it like the brother-in-law and have a business credit agency provide you with information about the construction company for a fee beforehand.

I have now inquired with one trade (roofing) and they could only report positive things, very good payment discipline, etc. I have also requested a creditworthiness report from my financing bank and am curious to see if that will work.

Credit reports are never negative. Developer balance sheets are never meaningful. The broker and developer ordinance already helps since your payments are managed separately and the developer has no access to the money (2-account model of developer financing).

Basically just hope, or call the trades and pay according to the [Makler- und Bauträgerverordnung].
