I just took a look at the Heilerbachtal area, also via Google Maps… you have to say: it apparently goes well for a long time and is tolerated - until someone overdoes it and paves half of their property.
I also wouldn't want to be in the shoes of the residents in Emkum.
But it's as you say: it's illegal, and as long as something is tolerated or not criticized, it doesn't mean it's legal.
