... and as far as I remember correctly, the OP can claim the money civilly - if it can be proven via notarial contract or otherwise. Whether the effort and result are economically worthwhile, however, is another matter.

Leading question, Martina... that's what he was getting at.

Cancellation of the land charge somehow cost us 50 euros to the bank and 50 euros to the court. The notary included it "inclusive" with the notarization. Otherwise, it would probably have been around 80 euros.

It's about the principle. At the moment, we are at €500. Now the bailiff will be involved first. Of course, that costs extra again. After that, we will surely be over €1,000, which will then be recovered from us because the others think they don't have to pay. Whether that's the world or not.

Filing a lawsuit is always an issue. We don't have legal expenses insurance. That would probably exceed the budget completely. If the notary already had no success with a bailiff, then we won't have any either!

Principle riding is a tricky thing....

Stop the GV and pay the costs and, if in doubt, write them off under life experience. Throwing "good" money after "bad" has never brought anything good. If things keep going wrong, you'll pay anyway, so in your place, I would want to avoid accumulating pointless costs...?


Only the really old legal expenses insurances (taken out until around the mid-70s) covered contract law; so don't get upset about that either.

1. Pay the invoice yourself. Delays here are only unpleasant, and you are jointly and severally liable anyway, directly and immediately.
2. Request payment from the seller by setting a deadline. If they do not pay, follow the usual procedure to obtain a title.
3. You don’t need legal expenses insurance. You cannot lose the case, so there should be no concerns about being stuck with the costs. I assume that the seller has not yet completely squandered the purchase price.

"Es geht mir ums Prinzip..." are very popular last words before a truly significant loss.
