Unfortunately, I can no longer stop this. The notary says that he now has to take this route first and then demand the amount from us if he does not receive payment. But as I said, I don't believe I will get the money back. If the notary is already unsuccessful with the bailiff, how am I supposed to succeed there? Thus, I would still be stuck with the costs because I first have to pay the lawyer and also the court proceedings afterwards, even if the seller has already set the money aside or not?

Did the purchase price payment not go through an escrow account?

Escrow accounts are nowadays more the exception than the rule.

So our apartment purchase and the sale (just recently) both went through an escrow account. It’s simply too much money to take any risks. You never know what might happen to the buyer or seller, and suddenly their account gets frozen after you have already transferred the purchase price.

I see it a bit differently; the notary primarily wants to have his invoice paid. It can actually be all the same to him from whom, if it is your wish to keep the pending procedure manageable. In the end, you will probably also have to cover the costs of debt collection - voki? - if the debtor has no means. In the case of an assumed forced sale, it’s not so unusual that the purchase price has already been passed on.
