I have the feeling that the Lower Saxony building code states that rainwater and groundwater infiltration MUST only take place on one's own property.

Be glad that many things are regulated. In that respect, this too.

Even for me as a layman, it should be clear that if my property is at a higher level, I should ensure that my neighbor is not "flooded" with rainwater as a result. Talk to him about it.

As the three previous posts state: This is clearly a problem that your neighbor has to fix. "I don't care" is not an option here – even if it is convenient for him.

Thank you for your responses. That all sounds very good. I will print out the "§26 Niedersächsisches Nachbarrechtsgesetz" and go to him. Let's see what he says. I will keep you updated when I get the chance.

Presumably, for example, that the 'soil movements' mentioned there are not at all transferable to the 'stormwater drains' complained about here and wish you a nice day / a good life....

However, the development plan usually states in B- that water may not be discharged onto adjacent areas - which does not give you a subjective right against the neighbor, but could be a basis for the authority.
