Heating engineer does not finish his work

Hello,

we are in the middle of the final preparations to lay the screed and now our heating engineer simply told us that he will not finish our heating system. Does anyone have any idea who I can turn to in such a case? I have already googled for experts, but unfortunately found nothing.
If it now fails because of the heating, then we will not get the screed in this year anymore and we will have to wait until next spring... financially not exactly desirable, as you can surely imagine.

Did he say why he doesn't want to finish building the heating? Does he have no time or are there other problems?

Yes, he did. It's not a matter of time, there are other problems. Personal issues towards us. To explain: There were repeated disagreements throughout the entire construction phase. We did not want plastic water pipes, but stainless steel ... he thought that was dumb, but he did it. He installed a different (cheap) HWS than he had offered, but charged for the offered (expensive) one. We did not find that funny, as we wanted the offered one (now we have it too). We want the underfloor heating with the pipes that have aluminum inside, which he considers exaggerated and so complicated to install. Etc., etc. And now he is leaving us hanging, with the reasoning that he 'can't do that' anymore.

Regardless of whether it is a free assignment, general contractor, or architect – all are based on a contract for work and services and this cannot be terminated without further ado ... only for a special, important reason.


Were all these changes discussed in good time and fixed in writing or did you only change your mind during the work on the trades; with the exception of the mixing valve – whatever that may be?

Without further information about the contract and the background it is not possible to answer your question. Apart from the fact that legal advice in Germany is exclusively reserved for the consulting professions.

As the construction expert already wrote, there must be a contract. The fact that you had special requests cannot really be a reason either; he could have declined them if there was another original offer. The only real solution is to set a deadline, with the threat that he will bear the costs for all delays caused by this. However, to make it solid, I would immediately rush to the (construction law) lawyer!
