Garage: What does "attached" mean? Does it mean that the masonry is connected?

Hello,

the development plan for my construction area states the following requirement:

Garages and covered parking spaces are:
- freestanding only permitted with a gable roof, shed roof, or green roof
- attached to the main building, only permitted with a gable roof or a shed roof extended from the main roof.

I am now wondering, how far must the garage be from the house so that it is no longer considered attached?
What about if I place a prefabricated garage directly against the house? Is it then considered attached? Or does attached mean that the masonry is connected?

I would like to avoid the gable roof.

In my opinion, yes. Here, "attached" is meant not in the technical, but in the design-related sense. I am not aware of any definition of the term "attached" in planning law. It is probably similar to the term "flat roof," for which there is also no maximum value defined in the law. It therefore depends on the design effect. Whether 50 cm is enough or whether it must be one meter must be decided on a case-by-case basis. If no further explanations can be found in the development plan, its textual provisions, or its justification, you want to build under the notification procedure, and you have strong nerves, you can also risk it. Such design statutes integrated into development plans often do not withstand judicial review. If your architect sees it the same way but you are still skeptical, you can also obtain the opinion of a specialized lawyer. The question is what a gable roof is worth to you. Perhaps you might also be granted an exemption (IMHO unlikely, plus then the notification procedure is no longer possible). Are there already approved or constructed buildings in the neighborhood?

I conclude that a flat roof is to be prevented, unless it is greened, and that only makes sense for a detached garage. The distance is not important. What is important: no flat roof! If you do not want a gable roof, you still have other options, e.g. shed.

With us, attached really meant connected to the house. Our house + carport are screwed together, then it counts as "attached". The distance is specified in the development plan or at the building authority.

Why is a green flat garage roof not sensible if the garage is directly attached to the house?
