Garage before occupancy external leasing

Hello everyone

We have purchased a turnkey terraced house in the middle of a row. This also includes a garage. The handover of the property is on 30.06.12.

Unfortunately, we have now learned that the builder has allowed our garage to be used by the neighbor who moved into his terraced house about three months before us to store his furniture, etc.

Is the builder allowed to do something like this without asking or informing us beforehand?
We have noticed that the garage is already damaged both inside and outside due to the usage.

If it is a genuine developer measure – house & property from a single source and payment in a few installment payments – the garage belongs to the developer until full payment; so he can do whatever he wants with it. You can also not care about it, as long as the garage is free of defects when handed over to you.
