Hi,

as mentioned, we have not signed anything. Neither the offer nor the accompanying text.
Regarding the accompanying text, my only response is that the offer with the 25k suits us and we would like to discuss the work on site regarding the start, etc.

In writing, I do not have it as a formal offer, but only as an accompanying text via WhatsApp (I also received the attached offer via WhatsApp).

From what I gather, that is not sufficient?

I apparently misunderstood that. My new understanding: The 35k was used to give the bank a false KVA. Anyone who looks for business partners who go along with something like that shouldn't be surprised if he has even more tricks up his sleeve. No, that is not enough if the landscaping contractor wants it that way. You orchestrated a shady deal and now get no advantage from it. The disadvantage is limited. Simply disconnect the house connection box and draw conclusions from it. Getting upset is not worth it.

I think it is a very strange approach to ask for advice on how to price in the black market sector in a public forum.
By doing that, you are cheating all of us because taxes serve to finance the community. Therefore, I advise you to settle this in court in the end, where at best you will get punished. The lesson you are already paying now is at least going in the right direction.
Sorry, but hiring illegal workers is simply antisocial.

Hi,

we were probably too naive here and wanted to save ourselves the effort. We invested the saved money from the offer into the electrical work and then showed that to the bank afterwards with proof in the form of invoices and pictures.

In general, I have provided the bank with evidence for around 90% of the costs from all measures. The bank waived the rest themselves.

So I did not want to cheat anyone but to save work in advance. But that won't happen to me again.

Everything that comes on top now, we will pay out of our own pocket.

Nasty trick. Write him a neutral email stating that you accept the price of the stated amount and understand which part is net and which part is gross. Also ask about dates in it. After completion of the work and payment of the demanded amount, you can insist on an invoice – referring to the email – and then pay the 19% on top. This email creates a file record that has a significant effect if left unchallenged in writing. Even better if the landscaper gives you dates without discussing the commercial terms. A usual reflex. This way you avoid payment for undeclared work. Net is not undeclared. Here the landscaper will then have a problem if he wants to add business costs and his tax burden.
