I understand. But if I wanted your money and knew that you had it, as a business owner I would simply waive the effectiveness of the clause afterwards. I don't understand that. They've just let a solvent customer slip away, haven't they?

The contract had already been signed with this clause. So the fish was already on the hook and couldn’t get away anymore.

It was originally supposed to be 1% of the purchase price. However, it was apparently on special offer at the time and was around 0.85%. The costs of a bank guarantee, which no bank wanted to provide, not even the lending bank, would have been similar.

I can understand the banks there. You take out a "small" loan for the plot of land and now they are supposed to guarantee the financing of your home? What if tomorrow you decide to blow the money, then the bank has the problem.

With a 100% financing, the bank protects itself by getting invoices for each disbursement. I would clarify that with the construction company. As a rule, they have employee-friendly payment agreements anyway. Otherwise, a bank statement should certainly also be sufficient for them.
