Contract withdrawal in case of financing not coming through
The contractual partner grants you the right of withdrawal free of charge, on the condition that no more than one basic investigation for order confirmation has been carried out by the contractual partner (provision of standard drawings and calculations for financing). A prerequisite for the free withdrawal, however, is that the client provides written proof of the rejection of financing requests from at least 2 independent banks.
The contractor is entitled to prove financing of the entire project provided that it involves market-standard conditions. For this purpose, the client commits to supporting and providing the necessary documents and data.
If you request a construction consultation for the creation of a building notification or a building application, the obligation to pay the "x" installment according to the payment plan arises. This installment is then due and cannot be refunded even in the event of a subsequent withdrawal.
If the building application is then created, the "x" installment is also due and cannot be reclaimed.
For the further progress of the handling of the order, the contract applies.
