that doesn’t sound good.
The construction supervisor is there precisely for such matters. Our expert specifically pointed this out. That he will take over the talks with the respective craftsman as far as we wish.
So that we as builders are not the bad guys. If the BS refuses to document his findings, I would contact the association. You initially gave him the opportunity to respond.

With just withholding the money, it’s not done... I think the defect should preferably be fixed!?

Hello Fantamoax Exactly that would also be in our interest, the craftsman should fix his own mess. With us, it was the plasterers with the base coat, after they did not want to fix their mess for whatever reason, we have no choice but to look for another plasterer. The sad thing is that this falls on us. Then we don’t need any BS if it just leaves us out in the rain. Regards

certainly, it is something else. What kind of contractual relationship do you have with the respective craftsmen? Who is in charge of site management?

The site management is through the construction company, they also brought us the plasterer, we have individual contracts for the trades everywhere, but they are coordinated by the construction company. The construction company only provides the shell, and since the last payment was made, no one really wants to take responsibility anymore.

You probably won’t like to read this now, but these are the pitfalls when – which I simply assume – such providers à la "all trades are tendered + you get the best price" were chosen as a temporary construction partner.

Apart from that, the engaged "expert" has duties which he is obliged to fulfill; likewise the shell builder, who provides the site management. So I would first initiate communication with the Verband privater Bauherren; you have booked the expert through them. I could well imagine that the association is interested in an amicable solution and will act as a kind of mediator. If this brings nothing, a lawyer must review your contracts and initiate the appropriate steps based on the VOB.

I am not allowed to provide further advice, as legal advice in Germany is exclusively reserved for the consulting professions.
