Exceeding the construction time, contractual penalty

Good day,
Our construction company has exceeded the contractually agreed construction period by 4 weeks. Should we have issued a warning? Or can we resort to the contractually agreed penalty? Do we have to prove damage caused to us by the delayed completion?

Why always try to break through with your head? Apparently the construction is finished, apparently there was no damage either, you may have already moved in and that's that. Be glad and happy or do you want to make a profit because money is tight?...

Apart from the fact that you apparently have been living in your apartment for several years and the acceptance was done, I ask: Was there even such a clause? It is very strange that nothing was communicated back then.

It is a multi-family house. We are a community of owners. When we have larger construction projects, we commission an engineering firm. Therefore, contracts according to VOB. In this construction project, there was a penalty clause in the contract of 0.25% per day, max. 5% of the construction sum. Normally, I am rather lenient and I would really not care if the facade and the roof were finished later. But there was a lot of dissatisfaction. (SEE MY OTHER POST) I volunteer as an auditor for the community and have to answer questions in the end. I don’t want to tell nonsense there but say something without emotions. Half-knowledge doesn’t help me there. I am therefore grateful for any advice, because I do not want to cheat a company nor the other owners. That is why I am asking.

Yes, and why has the construction time been exceeded by 4 weeks? First of all, it must be meticulously proven who is to blame. And only if the contractor has indeed acted culpably, then money can be given.



Where is the problem if you only audit? You describe the actual state and say that the site manager should have taken action and that maybe there was an overpayment. Has anything been paid at all?
Calmly point the finger at the people who messed it up and take care of the construction.
