Enclosure - is a hedge/privacy screen allowed?

Hello forum,

my partner and I would like to build. We have a good chance of obtaining a plot of land in the next few weeks. However, we have a question about the development plan regarding the topic of enclosure.

One of the preferred plots in the new development area borders a footpath that runs between two plots. Naturally, one would like to have some privacy on the property, preferably close to the boundary so as not to visually reduce the plot.

The development plan states:


If one now wants to build a hedge or other privacy screen (>0.8 m), how far must I stay away? The neighbor law will not apply in this case, since the plots are separated by the public footpath. Unfortunately, I cannot find anything about this in the road law.

If you really cannot build any kind of protection there, the plot is unfortunately out. We do not want to enclose just the terrace either.

Can anyone help?

Honest opinion. Just do it. No one will complain if the hedge is 2 m high. Or set it back 2 m, then they can’t do anything anyway.

Is the footpath used frequently or is it more of a kind of "no man's land" that nobody really enters? (I would consider the latter an advantage.)


I can’t say anything about other privacy screens, but a hedge >0.8 m probably won’t be regularly checked. And you can’t really tell hedges how high they may grow. ;-) Plan B, just trim it if an authority actually inspects it. Plan C, choose bee- and insect-friendly hedges, then you can argue better in a discussion with the authorities.


Are there good alternatives to the plot?

But we would really hate to give up those 2 m. Behind it is really no man's land.

That will be the exit from the new residential area for everyone who wants to go for a walk towards the fields.
So there will definitely be activity there.



The one right next door, for example. So not in the direction after the footpath, but the other way.
Same dimensions, same unobstructed view to the west. Outskirts of town.

Unfortunately, it's not a wish fulfillment game :D

Roughly indent one meter for every additional meter. I don’t really know exactly either.

Check whether the path is even public space in that sense or only belongs to the new development area, namely communal space. There are differences there, I think. I would avoid Plan B or C because that causes headaches and trouble.
However, no one will probably check the meter down to the centimeter ;)
