During yesterday's visit to our construction site, two things caught my attention:

- The formwork boards for the ground floor ceiling were fixed with nails driven from the inside out. All nails protrude about 2 cm with the tip out of the board. If you are careless, you can scrape your skin anywhere.

- A very wide scaffold was set up, consisting of planks laid side by side. Between the two boards there is the scaffolding frame and a 30 cm gap. It looks a little as if two scaffolds had been placed next to each other. This is certainly comfortable for working, but if you step into the gap between the boards, you won't fall off, but you can injure yourself and perhaps break a leg or something.

Now I am wondering to what extent I am responsible as the client and should/must take measures to remedy this. We have contracted the work to a developer. Should I just let him work and hope he knows what he is doing, formally point this out to him, or demand corrective measures?

When purchasing from the "Bauträger," you are not even the landowner. Therefore, not responsible.

Thank you for the quick response.
We purchased the plot ourselves but commissioned a developer separately to build our single-family house.

Then it is not a developer. The answer to the question requires information!!!

I have provided information, but maybe I am using the wrong terms. I have always received different explanations regarding the developer. So, here is a more detailed explanation: We bought the plot of land from the city and we are registered as the owners in the land register. Then we consulted a planning office for turnkey construction, planned our house, and commissioned this company to build our single-family house. The company is a general contractor and in turn hires subcontractors for the execution of the individual trades. In my opinion, the company is therefore our developer. Please excuse me and correct me if I am wrong.

The Berufsgenossenschaft yelled at the craftsman who was on site at the time - neither I nor the scaffold builder (who did something wrong) noticed anything about it.
