Does the garage fall under §14 of the Building Use Ordinance?

We have reserved a plot of land in a new development area. I would actually like a double garage. Now the development plan states the following:

    [*]Garages must be set back at least 5.0 m behind the street boundary line.
    [*]Garages are only permitted in one of the lateral boundary clearance areas.
    [*]Outbuildings in the form of buildings according to § 14 Baunutzungsverordnung are only permitted up to a floor area of max. 20 m² and a height of max. 2.5 m. Only one outbuilding is permitted per plot.

Do garages also fall under § 14 Baunutzungsverordnung? What is the floor area of a double garage? Is it possible at all then?

a) No, because §14 of the Building Use Ordinance "(1) Except for the facilities mentioned in §§ 2 to 13" ... (garages are dealt with in §12) b) from approx. 6mx6m=36m² c) points 1-3 do not speak against it IMO. If there is enough space and floor area ratio etc. do not speak against it, it could be possible.

Thank you for the response. The plot is 540 m² in size and the floor area ratio is 0.3. Unfortunately, I do not know the width of the plot at the moment.... But apparently, no distance to the neighboring plots has to be maintained...

Hello McEgg,

if I interpret this correctly, you are allowed to build a double garage (provided there is enough space). Apparently, only construction on both sides of the boundary is to be prevented here.
