Deviations from the development plan clinker - experiences?

Hello,

I have a question for you and hope for experiences or tips

We are planning to brick our house in a new development area with a binding land-use plan. In the land-use plan, bricks in the colors "natural red, red or red-brown" are permitted. We have chosen the Vandersanden brick "Vecto," which is described by the manufacturer as brown. However, our house construction company describes this brick as "dark brown with white nuances" and therefore wants to submit a building application instead of a building notification, since from their point of view we would deviate from the land-use plan.

We have already tried at the building authority to find out what chances of approval we have with this brick. Unfortunately, no one could give us a "confirmation" or even a tendency beforehand. We are supposed to submit it and wait... Of course, we would like to weigh our options in advance. Therefore, I wanted to ask if any of you might already have experience (preferably in Mecklenburg-Western Pomerania) when the requested brick color deviates from the land-use plan?

Hard to say. The construction company—[gebranntes Kind]?—is very cautious. So: strictly speaking: it is not red, or reddish-brown. My opinion would be to choose one clearly compliant with the plan and save myself the costs and delays and NOT burn the money there. Karsten

Thank you very much for your reply! The company is probably simply "overly cautious," which, considering the liability situation, is somewhat understandable. By the way, I meant that "red, natural red, and brown" are permitted in the B -plan. Dark brown actually belongs to the color brown for us, but okay, we have to accept it that way. Juliane

Is the building authority so uncommunicative?

A brief anecdote about this: Friends of ours built in a development plan area where only minimal deviations in the roof tile color "red" were allowed. The lady of the house packed 4 or 5 tiles (1x desired tile in a Mediterranean shade, the rest in abysmally ugly) and presented this as the selection available to them to the building authority. After that, it was fairly clear that they would get approval for a deviation for the desired tiles.

Actually, unfortunately yes! We have repeatedly tried to get a statement by phone, also by email. However, we were told that no commitment can be given in advance, but an "application for exemption" is required. But as I said, they did not comment on any tendency. Therefore, I assume that a personal "appearance" is also unlikely to be successful. We are now wondering how high the probability is that they will approve it, but I guess we just have to wait...

If according to the development plan "red, natural red and brown" are permitted... one should have enough imagination to argue that BROWN is also BROWN! Moreover, the manufacturer also calls the color that. So if I wanted the stone, I would know how to manage it. Something like how the lady of the house does at Domski's friends.
