Development plan with eaves height 3.5m and wall height 6.5m - what applies?

Hello everyone,

we are at the very beginning of the house-building journey but want to start quite quickly.
The plot is already available (1000sqm) and we already had concrete ideas for it (city villa).

Now we have read in the development plan that a maximum eaves height of only 3.5m is allowed. Ridge height 9m.
However, a maximum wall height of 6.5m is also specified?

Eaves height explanation: The eaves height corresponds to the height of the upper edge of the gutter.
Wall height explanation: The wall height is the measure between the final adjacent ground level and the upper edge of the roof covering (at the intersection with the extended line of the outer wall) on the eaves side.

Now I don’t know which applies – the eaves height or wall height?
It is not possible to build a house with a 6.5m wall height and a 3.5m eaves height, is it?

If anyone has great floor plans/ pictures for this, please send them. We are very puzzled about how we can plan our dream house with a 3.5m eaves height.

Your community should make itself clear, because like this

this is nonsense. The eaves height explanation corresponds to the misconception of the "common parlance", relating the term eaves height to the namesake gutter, even though the wall height explanation given here is the correct one for the building law term content (which the development plan should actually only refer to).

A wall height is actually the same as an eaves height and is used as a term merely to clarify that this height limit also equally applies to flat roof building parts. Thus, both terms mean the same thing in content, and that this height should differ from itself by three meters is not possible within the same reference system.

I don't know if it matches your dream house. But the classic 1+D construction with a low knee wall or dwarf wall should suffice.

If by city villa you mean the standard two full floors with a relatively flat roof on top, then that probably won't work here. You might rather have to consider getting used to the "1.5-story" houses. Otherwise, it might also be worth taking a look around the neighborhood to see if there have possibly already been exceptions and if that might also be an option for you (I’m not very familiar with this, but certain things can perhaps also be checked in a preliminary building inquiry).

But you don't build three meters lower just because the development plan "speaks unclearly".

Does it speak unclearly?… … Or is it the OP who is not reproducing exactly what is going on? Please post the original text here or the legend of your residential area. I think something got mixed up here ;)
