Developer - Is withdrawal from the purchase contract possible?

1. Why didn’t you demand guarantees in the contract? A construction company will not voluntarily provide them. They are all additional costs.

2. Did you sign the installment payment plan as it is? If it doesn’t fit, why did you sign it then?

3. Does it say anywhere in the contracts that construction should have already started? Surely the completion for occupancy is regulated. From 09/12 to 09/25/2012 I don’t find excessively long either.

4. Do you actually have a right to copies of the documents? With a developer contract you are not the builders.

You just need to enter Bauträgervertrag on Google and you get the keywords Makler- und Bauträgerverordnung and Bürgschaft.
This is probably the biggest investment in your life and then every damn thing gets signed.
So you can blame yourself for points 1 and 2, points 3 and 4 I cannot assess.

Sorry. My sympathy is very limited.

I think cold feet play a big role here. That a builder is sometimes not reachable is unfortunately the norm, and that not everything always runs as quickly as desired is too. Signature and the start of construction are often one year apart. I know at least 3 providers who cannot manage faster due to the high order volume. Someone who tells me I can move in within 6 months, I personally would not trust.

What do you want then?

You have probably already had the idea with the Verbraucherzentrale and lawyer yourself.
No one here can really recommend anything else on how to reverse the mess (that you signed yourself).

I have one little tip.
Try calling the construction company with a withheld number. If someone suddenly answers, then you'll know where you stand.

Hello Musketeer, I am definitely not a crybaby, but I find your tone inappropriate. It is little helpful to accuse someone who is seeking advice here. Pardon - I just had to get that off my chest.

Thank you Baucoach, we have now handed the matter over to the lawyer and the [Verbraucherzentrale] also wants to get involved, as several others have already been there for consultation. It will be an expensive lesson for us and we are now done with the topic of new construction.
