Damage to neighbor's house or street - who is liable?

At our unpaved foot and bike path, we were responsible for restoring it. We have a Baudispenz contract. However, not the road. Although it was not damaged either. A company caused damage by incorrect turning on a cobblestone driveway and repaired it after our request.

Regarding the topic of renovation, I heard on the radio in the last few days about a change according to which the residents can NO LONGER be involved "just like that". However, I am not sure whether this only applied to NRW (where I live) or nationwide. There has often been great injustice in the distribution of costs; often municipalities did not repair streets (repair = cost center municipality) but waited until they needed renovation (renovation = cost center residents).

This only concerns NRW and it is not exactly as you say. Streets have indeed been "repaired". The current regulation as of 1.6.22 will be the ultimate election gift. However, you can now assume that the streets will no longer be renovated at all. Because the municipalities have no money for it and the state does not pay for it either.

For me, it's about Baden-Württemberg. Is there possibly an insurance that covers such potential damages? It's not certain that anything will break ;).
