Conventional building permit procedure / simplified procedure?

Hello everyone,

our architect would like to submit our building application via the simplified procedure (§ 57 of the Hessian Building Code) instead of the "conventional" building permit procedure. As I have already found out, only a limited review takes place here. For example, fire protection, distance areas, parking space regulations, etc. are not checked. The responsibility for this apparently lies with the client.

In your opinion, is it uncritical to handle the whole thing through the simplified procedure, or is all responsibility, which actually lies with the architect, transferred to the client?? This would be rather critical in case of a problem!

Caution lay opinion: Isn't it exactly the other way around.... isn't the architect responsible for ensuring that all regulations are complied with? The client does not have the necessary expertise to oversee everything.... Or was that only the case with us, since we built according to [§34]?

Just came across a page from the state of Brandenburg via a search engine. It says:

This abbreviation of the procedure can be achieved because responsibility is shifted to the project planner and the lower building supervisory authority only carries out a limited review. The project planner declares that he has thoroughly examined the admissibility of the project according to planning and building regulations and takes responsibility for this review himself.

The client receives a building permit with declaratory effect after the procedure is completed.


Accordingly, the responsibility would then actually lie with the project planner (=architect?). Can anyone confirm this also for Hesse?

Hello,


You don’t need an explicit confirmation from a user in Hessen; this applies throughout the entire country.

By the way, you should do something nice for your architect at the next opportunity – the simplified approval procedure is considerably cheaper than a regular building application.

Hello Der Da,


The difference between the two procedures is that with the regular building application the authority reviews it; with the simplified approval procedure the architect confirms compliance with all building regulations by means of his signature.

Liability for the accuracy of the information remains the same in both cases; it always lies with the planner.
