Construction contract - Contract changes with finishing providers

Dear forum members,

are there any experiences with requests for changes to the contract with turnkey solid construction builders? For example,

- That you want to have all working plans, all operating instructions, energy demand calculation.
- Change from "We reserve the right to possible plan or building material changes" to "Changes only by written consent" or similar.
- More precise definition of the fixed price, e.g. valid from...to
- Demand for the front door key as soon as one is installed (property rights issue)
- etc.

As a supplement: I would also like to have the following sentence deleted: "Im Verlauf der Bauarbeiten anfallende Baustoffreste verbleiben hingegen nach Abschluss der Arbeiten auf dem Baugrundstück." -> Am I the garbage disposal or what? :)

Are you building turnkey with a company?

In Germany, there is freedom of contract, you can change everything. It always depends on which company you are building with. There is the Woolworth of construction. Tightly calculated, standard contracts, additional services like disposal cost extra. Or the Gucci of construction. So expensive that they treat you like a premium customer and have so much margin in it and agree to every change.

Edit: If you have already signed, you usually have bad luck with both.

Depending on the provider's workload, these things will be possible or not. Everything is a matter of negotiation. I estimate that the removal of the garbage will be quite easy. The issue of changes in building materials will increase the company's risk. Therefore, it is rather questionable whether he will go along with it in that way.

Hi,

except for the "Hausrecht," everything was easy for us. On this topic, there were and are no compromises with most providers. We got along well with the subcontractors and were then able to come in outside of the construction activity. If craftsmen were/are on site, that's not an issue anyway. The trash was always taken away or disposed of in a timely manner. It worked great. Changes were always agreed upon in writing and had to be confirmed.

Unauthorized wall relocations like in are an impertinence that, in my opinion, should not require an explicit exclusion between civilized contractual partners; and are also rare enough not to have to be guarded against prophylactically. Whether your aerated brick comes from Schlagmann or Wienerberger or your aerated concrete from Hebel or Ytong should not matter to you as long as the same compressive strength class is delivered – after all, that is what the phrase "or equivalent" is for. A meter cabinet in pearl white in stock at the wholesaler is, in my opinion, better than pure white six weeks later. You should not deny your site manager the necessary flexibility here either. I explained which reasonable and not dishonest reasons there can be for a needs-based adjustment of building materials to constructions; the related post "Plan change: changing from concrete to a wooden ceiling" highlights similar good reasons for another component. I advise you to inform yourself before harboring exaggerated fears that your contractors are constantly cheating you everywhere through creeping or secret performance degradations.
