The crucial point should be not to OWN another one. Having owned one before, according to the wording, does not represent an obstacle from my understanding. As I said, sell now and agree on a right of use with the buyer. From my layman's perspective, that should meet the requirement. Edit: Ah, I didn’t see the part about the building application, that would of course be unfortunate...

The application is denied. Just don’t include the BK in your financing plan.

Check with legal protection first whether administrative law is covered and if it also covers subsidies in the private sector ...

"Requirements for homeownership
Funding is provided for the first-time purchase, meaning the initial purchase or new construction of owner-occupied residential property in Germany. If your household (applicant as well as spouse or life partner or partner in a marital-like community or children) already owns a self-used, rented, usufructuary-used, gratuitously transferred, or vacant residential property in Germany for permanent use, funding through the Baukindergeld is not possible. The cut-off date is the date of the notarized purchase contract signed by the buyer(s), the building permit, or the earliest possible date of commencement of construction according to the building notification for the newly acquired or newly created residential property. It's interesting how people react when they are not told what they want to hear ... but also understandable when 48000 slip through their fingers due to their own fault.

After the arrogant appearance, I don't really feel sorry for the OP either. By the way, a call to the KfW or the financing bank helps. But apparently, calling the lawyer is easier since the OP already knows the number by heart.
