Changes to the notarized performance description

Hello everyone,
regarding the construction and performance description of our apartment (multi-family house from the developer), we have change and addition requests. For example, different fixtures should be installed in the bathroom, an additional drywall partition should be built, and of course, more sockets should be installed. Some of these are cost-neutral (bathtub instead of shower), others result in an additional charge.
How does one properly document these requests (and prices)?
The (incomplete) construction and performance description as well as the (not complete) floor plans are attached to the purchase contract, notarized by the notary. Do you now make a supplementary document with the deviations with the developer or a contract separate from the notarized contract regarding the special requests?

With us, all special requests require a separate order to the developer after we have received an offer.

Hello,

we had a similar case as well. The construction performance description was changed to include special requests as far as known before the notary appointment and was then notarized afterwards.

Further special requests were offered separately, accepted, and then commissioned. There was also a "swap" once, for example, a towel warmer was notarized and then removed later and credited.

You don't have to do anything more, every visit to the notary would cost money or the developer would not cooperate. The only gray area is the 5-year warranty, it may be that the subsequent special requests are only limited to 2 years.

Hi,

so the scope of work description was already changed by you in a few aspects before you had the appointment with the notary? For some things (floor coverings, for example) it also makes sense to clarify them afterwards, as they increase the purchase price and thus, among other things, the notary fees. I find it strange that, for example, the floor plan is not exactly correct. A (drywall) wall is in the wrong place and we would like it (cost-neutral) somewhere else. Now I am a bit afraid that it will ultimately end up where it was originally planned. ;)

therefore secure it. Best to have it changed before the notary appointment. If it doesn’t work quickly due to internal procedures, at least get it confirmed by email, fax, whatever (not verbally). Of course, it is clear that after the notary appointment you cannot put any pressure on the developer.
