Change of usufruct rights, can the bank refuse?

A unit is to receive an exclusive right of special use to the common corridor and a niche by partial declaration. A financing bank is now being difficult and wants to see drafts. For us, it is not a value-relevant change. Can the bank fundamentally refuse it?

I would already go on strike as a co-owner just as you put it in general terms. An exclusive special right of use in the GENERAL corridor is out of the question. How are the other units supposed to get to their front doors then? They would be unpledgeable, unfinancable, and unusable. Yes, the bank is allowed to be difficult and, if necessary, terminate the loan due to a significant deterioration of the collateral (which, by the way, I would do as well).

What makes this special right of use so attractive? Lenders can object to a significant change.

No, not really. That is the part on the top floor. All good

It is also not a deterioration

I would never grant a GENERAL part with a special usage right. NEVER NEVER NEVER!!!

why?

we also have the garden as a special usage right

if it were general, everyone upstairs would be walking around in the garden

the same right upstairs. if the hallway in the attic is general, I could always put my cheese nicely in front of the neighbor's door

I don't see it so strictly
