Building burden entry 11 m garage

I have the following question:
We want to build an 11 m long garage on our property.
For this, we would like to request a building encumbrance [Baulast] from the neighbor. Now we just don't know which neighbor.
Bordering our property is a private road about 30 m long and 3 m wide, and along that road there is a garage (3 m wide) and next to it the neighbor's house.

Summary: our property, then 3 m wide road, then new property (garage with house)

Who should I contact, the owner of the road or the homeowner?
