Building application due to parking spaces not approved. What can happen?

There are so many regulations about what is allowed.

Our property has a little more than 20m along the street. But we are only allowed to create three parking spaces on each side. Therefore, a driveway must also be built, which in turn takes away a parking space. In addition, we are allowed to build over a maximum of 10m.

At the back of the property, a maximum of two parking spaces can be created, or the neighbors’ consent is required. In this case, among others, there is a school, and so far it has not been possible for us to obtain consent.

Underground garages are generally prohibited. Double parkers as well.

An underfloor system is too expensive for us so far. About €70,000. If it is built at the front by the street, extra things must be considered. Then it becomes even more expensive.

The release of two parking spaces was rejected by the magistrate.

There is a shed on the property that we would like to keep in order to store bicycles and so on. Therefore it is difficult to accommodate anything on the south side of the property. The shed is divided and half belongs to the neighbor, who runs a catering business from his half. A demolition would cause me many headaches.

I just spoke with the civil engineer. We will create a maneuvering area at the rear end of the property that will allow us to place the parking spaces in the middle of the property.

We hope to get approval for this. So we will not be bluffing.

That sounds like you solved it very effectively.

Poker is a game where a good player leaves a worse player no chance in the long run.
The fewer rounds you play, the higher the element of luck becomes. With the building authority, you would have played with only one hand.

That is of course true. The expected value would have had to be immense to overlook the variance.

Just an update:

We submitted the changes on December 15th and haven't heard anything from the building authority since then. Today is March 15th, so 3 months later, and we haven't received any mail.

So, would we actually have a fictitious building permit?
One sentence that still puzzles me is in a letter dated April 13th, 2021: "... [then], you will receive a separate confirmation as soon as your application is complete. Only from this point does the legal deadline start ..."

Could it be that they simply never respond and then have unlimited time to process the application (in Hesse)?

We did not receive this confirmation. We haven't received any letters at all since December. My construction engineer will call them about it on Thursday.
