Yup, especially "Einwurfeinschreiben"! Return receipt and delivery confirmation are worthless in these cases.

One more question, is the developer only allowed to pass on the costs from the contract with the specialist contractor 1 to 1 here? Or is he also allowed to add his usual "general contractor surcharge" for construction management, planning, etc., which he applies to all his contracts in the calculation? After all, it has been paid including this surcharge. Is there a specific regulation regarding this?

hm... we are doing individual awards. Therefore, I cannot assess this legally. However, since the BAFA information sheet says "inklusive Planung blablabla...", I would naively first think yes.

I am not a lawyer, but I am of the opinion that you are the applicant, your costs are stated.

I would visit the developer at the office and politely insist on signing the document. If that does not succeed, simply withhold a good portion of an invoice (if not everything has already been paid).

I have actually considered that as well. I don't really want to argue with them; they are a good developer who built us a nice house, and all construction defects were promptly fixed after acceptance. That's not always so relaxed, so I don't want to upset them if it's not necessary. However, I also want to keep my affairs in order, and counting five-figure sums in cash in the account counts as that for me.

Is that a legally correct reason to withhold an amount from the final invoice until they have stamped the document for me?
