Boundary distance of trees after land subdivision

I cannot understand that or it doesn’t make any sense!!! Here is a thought experiment:
Property owner B plants a tree 3m from the property boundary (below the permitted boundary distance) on his own land, but not visible behind a wall or hedge. After 4 years, this tree is 3m tall. Only then does owner A notice it or feel disturbed by the tree. -> What would that mean then? The tree is grandfathered in because it has already stood for 4 years? What if, for example, owner A also does not mind the tree for 5 years, which may now be 6m tall, and sells the property, and the new owner then feels disturbed?

Have you perhaps had similar experiences or examples for your argument regarding grandfathering???

No, but I can read.

How about taking a look at the law yourself? (Thuringian Neighbor Law).
Whether it makes sense to you or not doesn’t matter. The law is the law. But it does (objectively) make sense!
Fundamentally, such deadlines serve legal peace, just like limitation periods in civil and criminal law.
