Boundary construction garage at another corner of the property

Hello dear forum members,

regarding the garage boundary construction in Lower Saxony, I have now read quite a bit, 9mx6m x3m etc. has now become clear to me, I believe. But how about the position of the garage on the property? Am I allowed to choose any corner I want? The development plan does not mention anything about the garage having to be in a specific position (e.g. the driveway). I have uploaded a picture. It is about property 43. According to the plan, the garage is drawn south of the property directly next to the garage of the southern neighbor. It would suit me better if the garage were located in the northwest corner (red rectangle marked). Can anyone tell me if that is allowed?

Hello Arthur,

only your building permit authority can give you a binding answer, especially since your attached image is apparently only a development proposal and not an excerpt from the development plan. If there is a legally binding development plan, the land use ordinance applies.

§23 Land Use Ordinance
(5) If nothing else is stipulated in the development plan, ancillary facilities pursuant to § 14 may be permitted on the non-buildable areas of the property. The same applies to structural facilities, insofar as they are permitted or can be permitted under state law in the clearance areas.


If the development plan does not provide information about parking spaces and garages, you can theoretically place the garage to the northwest. However, if the development plan sets a floor area ratio and is younger than 26 years, a driveway estimated to be about 50 meters long could be tight.

I would first inquire at the building authority about the sensitivities here. Among other things, there is also the requirement not to unnecessarily disturb the neighbor's quiet area, meaning garages, parking spaces, or carports must be built as close as possible to public traffic routes.

I would be interested to know what the access to the garage looks like then. The road connection is at the bottom right in the picture. Your garage position is at the top left. Do you want to pave half of the property?

Since you are so interested, attached is a first draft.
If I were to build the garage in the south next to the driveway, unfortunately half of the garden (which is oriented to the south) would be blocked. If you have any ideas about what would be best to do with such a property, bring them on.
PS: the property is about 31m x 25m

You will curse the garage for 50 years or stop using it by the third day at the latest. Or do you not realize that you then have to back around the corner every morning or back in in the evening and then turn the corner into the garage. Or turn around every time in 18 moves in the northeast corner!?

Put the garage on the eastern boundary, everything else is madness, unless you buy an additional 5-10 meters of land to the east.
