In our town (small town with about 17,000 inhabitants in Baden-Württemberg), the building authority has the sole power to decide. In the municipal council or the technical committee of the municipal council, only doubtful construction projects (with regard to the development plans) are decided.
Our building application was only presented in the technical committee of the municipal council, although there was no development plan for our property either. §34 of the Building Code also applies here.
The head of the building authority only briefly presented our project and explained to the municipal council members that the approval is granted directly by the building authority because the house fits well into the surrounding development.
