Unplanned interior area - does §34 of the Building Code apply? Experiences?

Hello dear forum members,

in summer a new residential area will be developed, in which we will most likely also get a building plot. However, our heart beats for another property, which the owner would also sell to us. But here’s the catch: the property is located outside a valid development plan. Since this is also a cluster of houses located on the edge (is this already a scattered settlement?), I don’t know if § 34 of the Building Code would even have a chance here. Before we possibly start a preliminary building inquiry, I would like to know how you see it.

Attached are two pictures to make it easier to understand. In the second picture, there is a district to the south and the city center to the east. It is a rural area. (Bilder entfernt, sorry =/)

If you black out text to remain anonymous, you should also be consistent, the location is mentioned 3 more times :D...

Well, simply go to the building authority in the first step and ask, you don't have to do anything official there.
It really depends on how the municipality wants to develop its city.

Where exactly? I have removed one club name, but I don't see the name of the town anywhere? Sure, with the connection of the street names it can probably still be figured out, but I thought blacking out would be enough as a first method. Basically, I blacked out because the property is privately owned and I want to assure at least a certain degree of anonymity to the owner. If it were mine, I wouldn’t care.

Without pictures, the question is harder to answer.

We also want to go to the building authority in the next few days. But I thought maybe I could get a few valuable pieces of information here for the conversation ;)

Just with "Heetweg" you can find the place :-) I would also go to the building authority: It is not certain whether they consider it buildable.

Google was very direct....



Just go to the building authority. Land use plans are sometimes cut strangely; but from Google Maps it looks more like §34.

The first route leads to the building authority. I suspect that despite the neighboring buildings, this could be an outlying area. In that case, good arguments are needed for development. Through the farmstead on the left, one could already mention gap closure. It would be good if you inform yourselves regarding development (water, sewage, electricity, fire department etc.) and offer a solution in case of being undeveloped.
