Yes, that’s exactly how I would do it too. You’ll find something out there.

As I said, normally they should approve felling with replacement planting for you. For two trees with a diameter of 30 cm, maybe six trees with a certain diameter specification. But you only get closer to the matter if you actually talk to someone at the "office."

If you want to build in Saxony, it even depends on which district it is. It can happen that you don't even need a felling permit during the felling season, that is from November. What kind of deciduous trees are they? If you are allowed to fell - I would be interested and possibly also transport it away ;)

As already mentioned, it is common for trees to have to make way for construction projects. It is building land after all. Of course, replacement plantings must be carried out. If the old trees do not happen to be nesting sites for the [Hufeisennase], the whole matter should actually be resolved with 2 adequate trees elsewhere. This can also be very well clarified and illustrated in the building application. We also submitted the replacement plantings and the cost-benefit analysis for the biotope to the Nature Conservation Office. Since we planted more than was previously there, it went through without any problems.

In all likelihood, you do not need a permit at all for trees with a diameter of 30 cm.

On plots with buildings and on communal areas in allotment gardens, the following cannot be protected by statute:


    [*]Trees with a trunk circumference of up to 1 meter (measured at a trunk height of 1 meter)
    [*]Fruit trees
    [*]Conifers
    [*]Poplars
    [*]Birches
    [*]Willows
    [*]Dead trees

This is regulated by law in § 19 paragraph 2 sentence 1 number 3 of the Law on Nature Conservation and Landscape Management in Saxony (Saxon Nature Conservation Act – SächsNatSchG).

But it says "on properties developed with buildings," not "buildable." Therefore, that will not help. Furthermore, the protection period from March 1 must also be observed.
