Tips for applying for a statute for the outdoor area

Hello,

we have submitted a statute with our municipality according to § 34 or § 35 of the Building Code for the development of two plots of land in the outer area.

The application will be handled in a non-public meeting of the building committee. I had actually planned to attend the meeting and explain my reasons for the statute in conversation. Unfortunately, that is now not possible.

I would like to help the committee make a good decision for me. So no bribery or monetary donations, but simply a written presentation of the situation including reasoning.

Can anyone give me tips on how I could successfully achieve my goal?

I assume you have submitted an application for the amendment of a [Satzung]? The information is very sparse. What exactly did you apply for?

Are you an agricultural business? Try googling privileged construction in the outer area

Hello Klappi!

Without support from an expert, this is doomed to fail. The key question is actually whether your BV is privileged. If not, it will be very difficult – you really need to be familiar with building law. Helpful here would be your application with a map and a short description of your BV.

The statement from our municipality is that for development in the outer area, a statute must be applied for informally. Such a statute exists, for example, for the Nebenstrasse, which was also built with single-family houses. The Nebenstrasse is also an outer area and does not include any agricultural buildings. If a statute is applied for and approved, building on a meadow is generally possible. This statement comes from both the district and the municipality. It has nothing to do with agriculture or a privileged project.

So I, together with another family who also want to build, have created a document in which we ask for the establishment of a statute for the corresponding parcels. The two plots are to be built on with one single-family house each. The houses are not intended for rental but are to be occupied by people who grew up in the municipality.

At the beginning of July, the building committee will meet and decide on the application. If the meeting were public, I would go myself and could possibly answer or ask questions. Unfortunately, the meeting is not public.

Therefore, my idea was to present my reasons and arguments in favor of approving the statute to the committee, as a small positive aid to decision-making, so to speak. Tips and experiences would be helpful for this.

Get the application for the existing road and formulate the application with the building authority so that it is approved in the meeting.
