Stone throw on foundation slab - builder's liability insurance?

Hi,

gravel stones were thrown on our freshly poured concrete slab.
Does the prefabricated house provider have to pay for this since we bought a complete package with the concrete slab and the prefab house? Or is this covered by the builder's liability insurance?

what does "thrown stones" mean? Small, large, a pile or just scattered ones?

Hello construction expert,

There are individual stones (10-20) of a size of 3-4cm. They got stuck in, and some apparently flew further upon impact and "only" left a hole.

I can't imagine that the prefabricated house provider is responsible here.

In case of vandalism damage, in my opinion, neither they nor the builder's liability insurance should be claimed.

Do you perhaps have any other insurance (construction all-risk insurance) for the house construction that you could use?

PS: Try asking the neighbors – maybe someone saw the stone throwers. To me, it almost sounds like a childish prank – maybe it would help to also ask around in the neighborhood in this direction...

Thanks for your reply. I also have a [Bauleistungsversicherung]. No idea if that would then apply.
Wouldn't I just be unlucky if it had been a child? Up to a certain age, they are not liable...

Ok. Once again.

From the description of my construction insurance coverage:

Covered are damages to the building that are due to..., vandalism..., etc.

If it was a child under 14, it depends on whether the parents fulfilled their supervisory duty in order to handle the damage via the parents' private liability insurance.
