Hello everyone :-D We are planning to build our house next spring, and the foundation slab for it is supposed to be poured already in October of this year. Now the "Amtlichen Wege" need to move pretty quickly, we think, so that we can get everything done by October, but have we forgotten a step or steps?? - first, we need all the papers from our architect (development plan, and the total cost breakdown as well as everything legal!?) - then an appointment with the bank regarding the financing, and at the same time have the papers checked by a construction lawyer.... - buy the property - then submit papers to the municipality and file a building application for October (I think that's done by the architect?!) - does the notary appointment come then ??:-D - and then wait for the red dot and get started??!! We are unsure about this, so we are grateful for your corrections :-D Best regards, Katha

Hello Katharina,

the notary appointment/property purchase usually takes place before the building application. It is possible that you or the architect submit the building application on "foreign land," but this is unusual and you will probably only get loans once you have signed the purchase contract with the notary. The loans are tied to the property, unless you are in the rare situation that you don't need any loans. Submitting the building application on foreign land involves the previous owner in the matter – this can be done within the family if the building plot comes from family ownership. Among strangers, this is unusual.

Therefore:

- Have plans and cost estimates prepared by the AR
- Clarify financing
- Arrange notary appointment for the purchase contract
- Submit purchase contract to the financier, who then releases the purchase price for the property
- Pay purchase price
- Then wait for the transfer of ownership in the land register; after that you will be listed as owners in the land register
- Then (the parallel prepared) building application on your own property

In terms of timing, I would say (in NRW) you are still on schedule, but it depends on how quickly/slowly the relevant authorities work in your area and how fast you can make decisions.

Notary for the land charge registration. This comes between the bank loan uptake and the first disbursement of the loan.

Furthermore, I would already make an appointment with the bank now to clarify at all what amount you can finance. You don't want to have something planned that you can't financially manage. The final financing appointment is then made afterwards.

For example, before we even decided on a construction company, we discussed our financial framework with our main bank.

I would insert a geotechnical report between these two points.
Without the results of this investigation, your entire planning could be rendered absurd (e.g., due to water-bearing subsoil or similar).
The report may lead to your entire plan being reconsidered because otherwise it might become too expensive or even unfeasible.
