Signature of prefabricated house under reservation with right of withdrawal

Good morning,

we have been planning the house construction project for quite some time now, and since we found a plot and looked at prefabricated houses - we have slowly started the financing process, which has been ongoing for almost 6 weeks and will be decided today - everything looks positive.

We went to the prefabricated house manufacturer for a preliminary sampling ... to see what additional costs might come on top ... all good! Now the consultant naturally wants to push for the signature.

The promotional package expires on 31.08.
According to the consultant, there will be a price increase on 01.09. (he mentioned this 2 days ago and the headquarters know nothing about it)

So we should sign by 31.08.

Of course, with reservation and with the right of withdrawal.

That means... he wants to include clauses that we can get out of the contract within the next 6 months if we don’t get a plot or financing.

And we supposedly always have the 14-day right of withdrawal...

I thought if we sign the contract on Thursday, I’ll have it checked by the trusted lawyer through the Bauherren-Schutzbund-ev - if he manages that within the next 14 days, we would be safe...

Right? What do you think?

Where is the point of the 14-day withdrawal right stated in writing in the contract? The pressure and the hint that it will get more expensive is a typical tactic. If no property is available yet, I would not sign under any circumstances. A soil survey of the property can still bring quite a few surprises. We have calmly planned the house (size, shape) to fit the property.

Consultant = Salesperson

A popular tactic among prefab house salespeople to pressure customers into signing.

When it comes to reservations, the exact written wording is very important. There are some that are fair and transparent; but also some that only remotely have anything to do with a simple cancellation.

By the way, what the salesperson tells you verbally does not count.

Did you receive a cancellation policy? (Regarding the 14 days)

Plot is nearly available. Unfortunately, it has not yet been finally surveyed, so no soil report.

We will receive the contract tomorrow. Then directly with the request for signature. Apparently, there will be something included about the right of withdrawal.

No idea if I can sign when it says 'with 14 days right of withdrawal' and/or 'subject to financing approval'.. Streif Haus is actually very reputable.

But you are not talking to the company itself; rather, to a salesperson who is mostly paid on a commission basis.

Have you ever received a sample contract? Or will you see the exact contract terms for the first time tomorrow?

we have the contract for work, the building service description, and so on available...
these clauses are not included, but as mentioned in the link one post before, they are not worth much anyway.

financing is promised
land can be purchased

we want to build the house with them...

so there is not much against signing

I just think it’s nonsense to be pressured and threatened with a price increase that the headquarters doesn’t even know about...
