Hello everyone,

I am interested in the feasibility and sensibility of the following procedure:

Father sells the house to Son 1 and he sells the house short-term to Son 2.

Within what time frame is something like this possible? So 2 notary appointments and 2 land registry entries.

And what costs arise?

The background is apparently the creation of the funding requirements for the Baukindergeld.

In my opinion, with one child and thus a funding amount of 12,000.00 euros, the effort is not worth it, as the costs for the 2 transfers could almost reach the funding amount.

In addition, all the gift and inheritance law issues also arise if the sale is not made at market value.

Don't fully understand the meaning yet...
Son 1 buys the house, registers there with his child, applies for the Baukindergeld, and then does the same with Son 2?

In case of a sale within the family, the Baukindergeld does not apply.

The KFW has recognized such trickery and made corrections.

There are double notary and land registry costs. The purchase agreement could be saved. Real estate transfer tax is only charged once (no exemption for siblings, as they are not directly related). You can check that on the internet. However, the notary will base his bill on the value of the object, not on the agreed purchase price.

I don't think the costs are worth it.

But the thing about Baukindergeld is not correct.

Only sales in a direct line are clearly excluded.

Brother to brother is not a direct line. This possibility was also confirmed by KfW over the phone.

As stated, this alternative is probably not suitable for "circumvention" due to the high costs.

Unless, of course, one has so many children that the effort and costs are worthwhile again.
