Sewage is leaking - water is running down the basement wall

Hello everyone,

we moved into our new house 4 months ago.
The plumber installed all the water / wastewater pipes for us.

About 4 weeks after we moved in, we noticed that the wastewater pipe is leaking and water is running down the basement wall when the sink / toilet is used.

After going back and forth with our plumber, the problem could not be fixed.

He claims that after he installed his wastewater pipes, we somehow damaged them.
We say that cannot be (we also do not know how that should have happened).

Now my question: Who has to prove who is at fault?? Us or the plumber based on the warranty?
