Separate land and generate building land? Where to inquire?

Hello,

a friend is slowly starting to want to build as well. His parents own a house with a 4000 sqm large plot of land, where there is practically enough space for another house. The question now arises, which unfortunately I could not answer:

1. Can a plot of land simply be divided?
2. Where can this be done?
3. Where can one find out if another house can be built there?
4. What could speak against it?

Generally: if there is a development plan, it applies. If there is only a land use plan (Flächennutzungsplan), that applies, then you must have an area with building rights. If this is the case, the "neighbor's rights" apply, meaning what they are allowed to build, you are also allowed to build §34 A Baugesetzbuch No building rights? Outer area? Environmental protection? FFH protected area? Reluctance of the responsible committees?

While reviewing the drawings, he noticed that only part of the property is designated as building land. The majority appears to be recreational garden area, grassland, or something else. The area marked as building land will be sufficient for another house, but then the houses will be 10m apart... Is there theoretically the possibility to include a piece of the green area as building land? How would something like that work?

Only the responsible caseworker at your local building planning office can answer that for you. Go there with your documents and clarify your situation in a personal conversation. And remember – there are people working there. Treat them the way you naturally expect to be treated by them, and you will get an informative conversation out of it. Even if this does not necessarily imply that your wishes to expand the building land will be granted.
