Sauna with boundary construction

we want to build a sauna on the border. With an electric stove. Everything is fine so far, the building authority says we have to submit an application and obtain approval from the neighbors that they agree (Hessen).

Now a neighbor brought up that I should also have the sauna registered in the land register.

Is that sensible and is it possible? Do I then have to submit a building application?

... and you get approval upon application, and if you want to build something, that is a building application. Since a (private) sauna usually occupies less than 30m³ of enclosed space, I think your sauna is exempt from approval. Because it triggers setback areas, but you want to build on the boundary, your neighbor must take over the setback area as a building encumbrance on their property. For this, they must submit a takeover declaration to the building authority.

I am missing the context of these three words. If you mean that the neighbor’s consent should be recorded in the land register, then this is possible, IMHO only sensible if one wants to agree on regular compensation payments. Otherwise, an easement only causes unnecessary costs upon registration and upon cancellation after demolition of the sauna. Since the land registration is purely a private matter, it has no effect on public-law procedures.
