Right of way / Medium voltage line (20kV) lies on the property

Hello,

I am in the process of building a house ([Bodenplatte fertig]). When applying for construction electricity, I received a call from the energy supplier stating that there is a medium-voltage line (20kV) on my property and that the construction company should obtain a line inquiry before starting construction. I was completely perplexed when I heard this, as no such line is recorded either in the municipal line inquiry or in the land register.
I have now submitted an application to the energy supplier to relocate this line to the public traffic area. I was informed by phone, as a preliminary notice, that the energy supplier has the right to leave such a line on my property without an easement.
My view on this is that as long as no easement is entered in the land register, the energy supplier is obliged to remove the line from my property free of charge.

Was the conduit mentioned in the purchase or in the notary contract? This should definitely have been done. If you acquired it from the city/town, one could possibly look for the error there.

I also believe it is crucial whether the cable runs directly through your property or if it was only laid on the edge.

No, it was not mentioned at the time of purchase. As stated, it is also not recorded in the municipal pipeline inventory. The pipeline is only marked in the pipeline inventory of the energy provider. Even in the traffic value appraisal, there is no mention of it. It protrudes up to 5m from the street onto my property. The construction area starts at a distance of 6m from the street.

We also had an electrical box on the property, without any easement, etc. That used to be the way it was done. It was relocated free of charge and without bureaucracy; you just had to ask nicely. A cable now runs along the edge of our property.

The duty to investigate lies with both the builder and the civil engineer. If your civil engineer dug without obtaining line information, he violated the DGUV.


If the line does not belong to the city, you won't find anything there.


Under certain circumstances, lines do not have to/must not be secured by easements. However, the location of these lines is then secured via the NAV.
Whereas 20 kV medium voltage usually serves supra-local supply and thus falls outside the scope of the NAV. Find out what purpose the line serves.


Get that in writing. Over the phone, they can tell you any story.


As said, that depends on what purpose the line serves.
