Right of first refusal - How do I find out if such a right exists?

Hello,

we want to sell an apartment in a residential block.

Is there a way to find out if anyone here has a right of first refusal on the apartment? The municipality or something?

Maybe someone knows.

For apartments, there is usually no pre-emptive right. Public pre-emptive rights arise from the Building Code or municipal statutes, individual ones are recorded in the land register.

If applicable, a pre-emption right due to the conversion into condominium ownership for the tenant (if the apartment is rented).

Otherwise, Fuchur has said everything on the subject. At the latest, the notary will address the issue in the [KV].

Ok. The apartment has not been rented out for 20 years. So I will definitely only find out about that from the notary when he draws up the purchase contract? Or can he tell me that earlier?

Well, the source is above. 99% of the time, none exists. For the last 1%, an inquiry at the municipality and a look into the land register (or you should know the latest status yourself) will make you wiser.

You can also ask him for his help before the sales contract appointment... or it will be automatically checked by him when he orders the land register excerpts.
