a family wants to remove a hedge in Saxony that is 14 meters long and 2.30 meters high and build a fence with a height of 1.80 meters. The problem is that a new official gazette was issued. Hedges in the inner area according to §34 of the Building Code from 10 meters length and 1.50 meters height are protected according to the statute for the protection of the stock of woody plants. The problem is that a construction contractor was commissioned in the summer and a 100% material deposit was paid (1500€). He already has the material in stock. The labor cost would be about 4,500€ for removing the hedge and installing the fence. The building authority says one should submit an application that will be reviewed. The contractor has not been spoken to yet. Preferably, they would like to leave the whole thing as it is. What is the best way to proceed? Can the hedge be removed? What could the contractor demand as a penalty? Who has experience with this?
